What is a divorce? The parties to a marriage may alter or terminate their relationship by commencing an action for divorce. A divorce will effect a termination of the marriage contract and a release of the parties from their mutual obligations. However, a divorce proceeding is more of an adversarial action, brought by one of the parties as plaintiff against the other as defendant.

What is a dissolution? A dissolution is an agreed termination of a marriage by both parties. A dissolution requires both husband and wife to work together through their attorneys to reach an agreement on all issues necessary for a full settlement of the case. All issues must be satisfactorily resolved before a dissolution may be filed with the court. A dissolution makes no reference to why a marriage is breaking up and no allegations of fault are included in any paperwork. Dissolutions contain three major categories of issues to be decided: the allocation of parental rights and responsibilities (custody), division of marital property, and spousal support.
